Presentazione della giornata
Ad un mese dall’emanazione del d.m.180 che ha completato la normativa relativa alla mediazione civile e commerciale disciplinata da d. lgs. 28/2010, l’incontro vuole essere un momento di approfondimento e riflessione su alcuni degli aspetti che potrebbero essere determinanti per il successo concreto dell’Istituto della mediazione in Italia.
Al fine di meglio coordinare i vari contributi e dare spazio al dibattito, la giornata è organizzata in due distinte tavole rotonde “dalla controversia alla mediazione” e “dalla mediazione all’accordo di conciliazione”, intervallate da un pranzo a buffet. I contributi riguarderanno tra l'altro: il contenuto della clausola di conciliazione, la forma della domanda, i criteri di selezione e nomina del mediatore da parte dell’organismo, la tutela effettiva della riservatezza, la procedura da adottare, la gestione dell’esito positivo e negativo, la procedura per beneficiare degli incentivi fiscali previsti dal legislatore.
Ne discuteranno con la Prof.ssa Chiara Giovannucci Orlandi (Università di Bologna) e la Dott.ssa Augusta Iannini (Ministero di Giustizia) i principali protagonisti: i vertici di Unioncamere e del Consiglio Nazionale Forense, studiosi da tempo attenti al tema, esperti degli Ordini professionali e degli Organismi, nonché mediatori professionisti.
La giornata è promossa dalla Facoltà di Giurisprudenza dell’Università di Bologna, con il contributo di UNIONCAMERE ed in collaborazione con ACEF Associazione Culturale Economia e Finanza e Associazione Equilibrio & R.C.
